Step-by-Step Procedure of admission of an Operator
to Conduct Flights (General Aviation)

Regulatory and Legal Framework

The operator's admision to perform flights (general aviation) and the provision of the public service «Issue of a certificate for the right to perform flights (general aviation operator)» is carried out in accordance with::

Key Definitions

  • General Aviation – civil aviation owned by individuals and/or legal entities and used for the carriage of passengers, baggage, cargo and mail (air transport), performance of aviation works, search and rescue and emergency response operations, assistance in natural disasters on a non-commercial and non-hire basis, as well as for training, sports, cultural and educational activities, development of technical creativity, and satisfaction of the personal needs of the aircraft operato.
  • certificate for the right to perform flights – a document issued by the authorized organization (authorized authority) in the field of civil aviation confirming the authorization of a general aviation operator to perform flights.
  • Authorized Organization –Aviation Administration of Kazakhstan JSC.

General Approval Procedure

The operator approval procedure includes the following steps:

  1. Determining the declared types of flights.
  2. Preparing the operator to meet certification requirements.
  3. Submitting the application and documents through the e-government portal.
  4. Document verification by an authorized organization.
  5. Conducting an inspection.
  6. Making a decision on approval or denial.
  7. Issuing a certificate and operational specifications.

The general term for providing the public service is 60 business days.

Step 1. Operator Requirements

The operator must meet certification requirements, including:

  • Availability of aircraft suitable for the declared types of flights;
  • Ensuring the airworthiness of the aircraft;
  • Availability of flight, engineering, technical, and management personnel;
  • Implementation and functioning of a flight safety management system (if necessary);
  • Availability of operational documentation;
  • Availability of mandatory types of civil liability insurance in accordance with legislation.

Step 2. Preparing the organizational structure and personnel

The operator establishes a management structure, appointing those responsible for:

  • Flight operations;
  • Flight safety;
  • Continuing airworthiness;
  • Aviation personnel training;
  • Quality control;
  • Aviation security (if applicable);
  • Occupational health and safety.

Step 3. Preparing operational documentation

Depending on the type of flight, the following documents are prepared:

  • Flight operations manual;
  • Safety management system manual (if necessary);
  • Continuing Airworthiness Management Manual;
  • Operator aviation security program;
  • Other documentation required by certification requirements.

Step 4. Submitting an application

The application is submitted electronically through the www.egov.kz portal and is certified by the applicant's digital signature..

A package of documents in accordance with the List of Basic Requirements for the Provision of Public Services (Appendix 2 to Rules 1023) is attached at the same time.

Documents and information available in government information systems are not required from the applicant.

Step 5. Document Verification

Authorized Organization:

  • Registers the application on the day of receipt;
  • within 20 business days, checks the documents for compliance with the Rules;
  • if the documents are compliant, proceeds to the inspection;
  • if the application is incomplete, rejects the application within 2 business days.

Step 6. Inspection

A commission of aviation inspectors is created to conduct the inspection.

The commission:

  • conducts the inspection within 8 business days;
  • evaluates personnel, aircraft, processes, and documentation;
  • prepares an inspection report.

Step 9. Decision-making

Based on the inspection results, the authorized organization:

  • issues a certificate and operational specifications;
  • or makes a reasoned decision to reject
    in accordance with the applicant's hearing procedure.

The results are sent to the applicant's «personal account» electronically.

Validity of the certificate

  • The flight certificate is issued indefinitely;
  • The certificate is not transferable.

Amendments

Amendments to the certificate and operational specifications are made:

  • at the operator's request;
  • or based on the results of an inspection by an authorized organization.

Suspension and Revocation of a Certificate

A certificate may be:

  • suspended - if violations of certification requirements are detected;
  • revoked - due to document falsification, illegal use, a court order prohibiting activity, or other grounds established by the Rules.

Appeals

The decisions and actions of the authorized organization may be appealed:

  • through administrative (pre-trial) proceedings;
  • or through judicial proceedings - after completing the pre-trial procedure.
