Step-by-step instructions for permitting an operator
to perform aerial work

Regulatory and Legal Framework

Operator permits to perform aerial works and the provision of the public service «Issuance of a certificate for the right to perform aerial works» are carried out in accordance with:

General Approval Procedure

The operator approval procedure includes the following steps:

  1. Determining the declared types of aerial works.
  2. Preparing the operator to meet certification requirements.
  3. Submitting an application and documents through the e-government portal.
  4. Verification of documents by the authorized organization.
  5. Conducting a certification inspection.
  6. Making a decision on approval or denial.
  7. Issuing a certificate and operational specifications.

The total time frame for providing the public service is 38 business days, with a possible extension if Level 2 nonconformities are identified.

Step 1. Determining the Types of Aerial Work

The operator determines the types of aerial work to be included in the operational specifications of Part B, including:

  1. aerial chemical work;
  2. aerial surveys and observations;
  3. aerial works for the protection and conservation of forest resources;
  4. construction and installation and loading and unloading works;
  5. flights on islands of open seas and oceans;
  6. flights from sea vessels and offshore drilling rigs;
  7. flights to provide medical assistance to the population and carry out sanitary measures;
  8. flights for experimental and research work;
  9. flying for landing and dropping parachutists or dropping cargo by parachute;
  10. search and rescue operations;
  11. flight checks (overflights) of ground-based radio technical support for flights, aviation radio communications and airfield diagrams;
  12. other types of aerial works related to the performance of specialized operations in the interests of other individuals and (or) legal entities.

Step 2. Operator Requirements

The operator must meet certification requirements, including:

  • Availability of aircraft suitable for the declared types of aerial works;
  • Ensuring the airworthiness of aircraft;
  • Availability of flight, engineering, technical, and management personnel;
  • Implementation and operation of a flight safety management system (if necessary);
  • Availability of operational documentation;
  • Availability of financial resources;
  • Availability of mandatory types of civil liability insurance in accordance with legislation.

Step 3. Preparing the Organizational Structure and Personnel

The operator establishes a management structure by appointing those responsible for:

  • Flight operations;
  • Flight safety;
  • maintaining airworthiness;
  • training of aviation personnel;
  • quality control;
  • aviation safety (if applicable);
  • occupational safety.

Step 4. Preparing Operational Documentation

Depending on the type of aviation works, the following documents are prepared:

  • Operations manual;
  • Safety management system manual (if necessary);
  • Continuing Airworthiness Management Exposition;
  • Aircraft maintenance program (regulations);
  • Instructions for performing specific types of aerial works;
  • Operator aviation safety program;
  • Other documentation required by certification requirements.

Step 5. Submitting an Application

The application is submitted electronically through the www.egov.kz portal and is certified by the applicant's digital signature.

At the same time, a package of documents is attached in accordance with the List of Basic Requirements for the Provision of a Public Service (Appendix 2 to Rules 1024).

Documents and information available in government information systems are not required from the applicant.

Step 6. Document Verification

The authorized organization:

  • registers the application on the day of receipt;
  • verifies the documents for compliance with the Rules within 15 business days;
  • if the documents are compliant, proceeds to the certification inspection;
  • if the documents are incomplete, rejects the application within 2 business days.

Step 7. Certification inspection

A commission of aviation inspectors is created to conduct the certification.

The commission:

  • conducts the certification within 5 business days;
  • evaluates personnel, aircraft, processes, and documentation;
  • issues a certification inspection report.

Non-conformities are classified as Levels 1, 2, or 3.

Step 8. Corrective Action (if necessary)

  • Level 2 nonconformities must be corrected within 3 months.
  • The operator submits a corrective action plan.
  • If the plan is not met, the Level 2 nonconformity is downgraded to Level 1.

Step 9. Decision Making

Based on the results of the certification survey, the authorized organization:

  • issues a certificate and operational specifications if there are no Level 1 or 2 nonconformities;
  • or makes a reasoned decision to refuse
    subject to the applicant's hearing procedure.

The result is sent to the applicant's «personal account» electronically.

Certificate Validity

  • The certificate is issued for 3 years;
  • for operators of light and ultralight aircraft - indefinitely;
  • the certificate is non-transferable.

Amendments

Amendments to the certificate and operational specifications are made:

  • at the operator's request;
  • or based on the results of an inspection by an authorized organization.

The timeframe for making changes depends on their type (from 3 to 20 business days).

Suspension and Revocation of a Certificate

A certificate may be:

  • suspended - if violations of certification requirements are detected;
  • revoked - due to document falsification, illegal use, a court order prohibiting activity, or other grounds established by the Rules.

Appeal

The decisions and actions of an authorized organization may be appealed:

  • through administrative (pre-trial) proceedings;
  • or through judicial proceedings - after completing the pre-trial procedure.
