Legal Aspects of Civil Aviation Development Discussed at the International Civil Aviation Organization Assembly’s Legal Commission

As part of the 42nd session of the ICAO Assembly, a meeting of the Legal Commission was held to address legal issues related to civil aviation. The Commission reviewed proposed amendments to Standards and Recommended Practices (SARPs) and provided guidance on the legal aspects of international civil aviation development.

During the session, Kazakhstan presented a working paper titled “Harmonization of Liability Laws for Aviation Authorities in the Era of Autonomous Flights: Defining Liability in AI-Operated and Unmanned Commercial Air Transport.” The paper was introduced by Mr. Aslan Satzhanov, Chief flight safety officer-member of Management Board of the Aviation Administration of Kazakhstan.

The initiative proposes that ICAO undertake focused legal work to develop a harmonized international framework that clearly defines mechanisms of liability and compensation in the context of autonomous aviation.

Kazakhstan emphasized that existing international conventions on liability do not fully reflect the operational realities of autonomous and AI-operated aviation. Therefore, new legal instruments or amendments may be required to ensure legal clarity and consistency as the aviation industry transitions toward greater autonomy.
