Air Astana fined for flight delays

Regarding the previously announced investigation in connection with numerous appeals from citizens due to long flight delays and violation of the rights of passengers, the Civil Aviation Committee of the Ministry of Industry and Infrastructure Development of the Republic of Kazakhstan reports the following.

In connection with the increasing flight delays, which caused a resonance among passengers, on July 18, the Chairman of the Committee, Talgat Lastaev, promptly held a meeting with Air Astana. During which the airlines pointed out the shortcomings of the commercial planning of aircraft, the inadmissibility of canceling regular flights, the lack of a prompt response to the replacement of aircraft, the lack of a prompt response from the airline's personnel in case of flight delays. As a result of the meeting, Air Astana allocated a separate aircraft to ensure the reserve, which will be used only in case of flight delays.

NWF Samruk-Kazyna JSC, as a shareholder of major Kazakhstani airlines, needs to intensify its work on planning the aircraft delivery schedule.

At the same time, on July 21, in order to strengthen interaction, meetings were held with the airports of the years. Almaty and Uralsk with the participation of the Aviation Administration of Kazakhstan JSC, Air Astana.

Due to the long delay of the flight Almaty - Male, which was scheduled for July 16, an investigation was carried out promptly within two days. Based on the results of the work, it was found that the passengers of this flight were waiting for the departure for more than 15 hours. While waiting, the passengers of this flight were not properly provided with the services provided for by Part 1 of Article 86 of the Law of the Republic of Kazakhstan “On the Use of the Airspace of the Republic of Kazakhstan and Aviation Activities”, namely hotel accommodation services.

In this connection, on July 21, 2022, an administrative case was initiated against the airline, during which a fine of 1,000 MCI was imposed on the airline (1 MCI = 3,063 tenge).

In total, to date, the Committee has received about 150 appeals, each of which is being worked on, as a result of which appropriate procedural measures will be taken as provided for by the current legislation.

In accordance with Part 1 of Article 567 of the Code, non-fulfillment or improper fulfillment by the carrier of the obligations stipulated by the legislation on the use of the airspace of the Republic of Kazakhstan and aviation activities, to provide services to a passenger in case of cancellation or delay of a flight due to the fault of the carrier or delay, cancellation of a flight due to late arrival of an air ship, changing the route of transportation entails a fine of 200 MCI. Also, the action (inaction) provided for by part one of this article, committed repeatedly within a year after the imposition of an administrative penalty, entails a fine in the amount of 1,000 MCI.
