AAK conducted an unscheduled inspection of FlyArystan

The Aviation Administration of Kazakhstan, on behalf of the Civil Aviation Committee, conducted an unscheduled inspection check of the FlyArystan airline from March 24 to March 28 of this year based on the appeal of passengers on the fact of refusal to transport passengers on flight KS 7341 in the direction Nur-Sultan - Kostanay dated March 19, 2022.

According to the results of the audit, it was revealed that the reason for the refusal to transport passengers was the restriction on the number of used passenger seats to one hundred and ten seats on board this aircraft, associated with a temporary technical malfunction of the evacuation ladder. Restrictions on the number of seats were set taking into account the requirements of flight safety, since it is not possible to disembark passengers in an emergency with a faulty emergency ladder. For this reason, the airline was forced to block 70 seats out of 180 available.

According to the Rules for the carriage of passengers, baggage and cargo in air transport, approved by Order No. 540 of the Minister for Investment and Development of the Republic of Kazakhstan dated April 30, 2015, if the passenger is denied transportation for reasons that pose a threat to the safety of the flight of the aircraft, then the amount for an unused ticket or part of it in accordance with Chapter 6 of the Rules, in accordance with the conditions for applying the fare.

So, from the moment the registration began, the airline organized work to search for candidates for voluntary flight refusal among the passengers of this flight, subject to the further provision of services by the airline, at its expense:

- alternative departure dates;

- hotel accommodation;

- provision of food;

- providing a transfer from / to the airport;

- a voucher in the amount of three times the fare of the purchased ticket.

However, due to the presence of passengers who completed online check-in and independently passed the screening procedure and then proceeded to the boarding waiting area, boarding was carried out according to the standard procedure until the number of passengers boarding the aircraft was 110 (one hundred ten) people.

According to information received from FlyArystan, passengers from flight KC7341 dated March 19, 2022, who were unable to use their tickets, can apply for a refund at the place of purchase within a year. I would like to note that due to the current emergency situation, the process of automatic return of aggregators does not function. In this regard, passengers should contact the support service of the aggregator.

Passengers from flight KS7341 dated March 19, 2022 can receive a voucher in the amount of three times the fare of the purchased ticket by contacting the airline's contact center at 8 727 331-10-10 or on the website https://flyarystan.com in the "Contact us - write to us."

On this occasion, the Aviation Administration issued an inspection order to FlyArystan, as well as given appropriate recommendations that would allow avoiding such situations in the future. The airline was instructed to fulfill all obligations to the passengers of this flight to refund the cost of the ticket.
